1. Service Description

TheMoment.digital ("we," "our," or "the Service") provides a digital wedding platform that allows couples to create personalized wedding websites, collect photos from guests via QR codes, and optionally order physical prints. This is a one-time purchase service, not a subscription.

2. Acceptance of Terms

By purchasing our service and creating a wedding website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our service.

3. User Accounts and Registration

• You must be at least 18 years old to use this service
• You are responsible for maintaining the security of your account and password
• You agree to provide accurate, current, and complete information during registration
• Each purchase creates one wedding website with a unique access link

4. Payment Terms

• Pricing ranges from 2000 to 3000 TRY depending on the selected template
• Payment is processed securely through LemonSqueezy
• All payments are one-time charges (no recurring fees)
• We offer a 14-day money-back guarantee if you are not satisfied with the service
• Refunds are not available if your wedding date is less than 30 days away or if the site has been actively used (edits made or guest content uploaded)
• To request a refund, contact us at business@the-moment-digital.xyz
• Physical print orders are subject to additional fees and separate terms

5. Service Availability

• Your wedding website will remain active for a minimum of 12 months from purchase
• We aim to provide 99% uptime but cannot guarantee uninterrupted service
• We reserve the right to perform scheduled maintenance with advance notice
• After 12 months, we may extend service availability but cannot guarantee indefinite hosting

6. Intellectual Property Rights

• You retain all rights to photos, text, and content you upload to your wedding website
• By uploading content, you grant us a license to display, store, and process it to provide the service
• The website templates, code, and design elements are owned by TheMoment.digital
• You may not copy, reproduce, or redistribute our template designs

7. User Content and Responsibilities

• You are solely responsible for all content uploaded to your wedding website
• You must not upload content that is illegal, offensive, defamatory, or infringes on others' rights
• We reserve the right to remove content that violates these terms
• You are responsible for managing guest permissions and moderating uploaded photos

8. QR Code and Sharing

• Each wedding website includes a unique QR code for guest access
• You are responsible for how you share and distribute this QR code
• QR codes are for personal wedding use only and may not be used for commercial purposes

9. Template Customization

• You can customize text, dates, photos, and other content within your chosen template
• Template structure and design elements cannot be fundamentally altered
• Custom CSS, JavaScript, or external integrations are not supported

10. Data Privacy and Protection

• We collect and process personal data in accordance with GDPR and applicable privacy laws
• Guest-uploaded photos are stored securely and accessible only via your unique wedding link
• We do not sell or share your personal data with third parties for marketing purposes
• You have the right to request data deletion after your wedding event

11. Limitation of Liability

TheMoment.digital is provided "as is" without warranties of any kind. We are not liable for:

• Loss of data due to technical failures (though we maintain regular backups)
• Service interruptions beyond our control
• Third-party content uploaded by guests
• Indirect, incidental, or consequential damages

Our maximum liability is limited to the amount you paid for the service.

12. Indemnification

You agree to indemnify and hold TheMoment.digital harmless from any claims, damages, or expenses arising from your use of the service or violation of these terms.

13. Termination

• You may request account closure at any time by contacting us
• We may terminate accounts that violate these terms
• Upon termination, your wedding website will be taken offline
• You may request a data export before termination

14. Dispute Resolution

• These terms are governed by the laws of Turkey
• Any disputes will be resolved in the courts of Istanbul, Turkey
• We encourage users to contact us directly to resolve issues before pursuing legal action

15. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify users of significant changes via email.
